Terms of service
What Evalie does and doesn’t do, how plans and refunds work, your rights in your work, and what each of us is responsible for.
The short version
- Each plan is one payment. There’s no subscription, nothing renews, and review credits don’t expire.
- A credit is spent when you create a review. Delete the review before your AI editor’s first notes come back and you get it back.
- You can ask for a full refund within 14 days of a purchase if your AI editor hasn’t yet written its first notes on a review made with it. Once it has, that purchase isn’t refundable, except where the law says otherwise.
- Your work stays yours, and so does the report. Your manuscript is held on our servers, encrypted, only while your report is written, then deleted, and we don’t use it to train AI.
- Your editor is an AI. Its notes are opinions about a draft, not a promise about what anyone will buy, sign or screen.
This agreement
These terms are between you and Probalia Ventures LLC, trading as Evalie, 240 Harriman Road, Irvington, NY 10533, USA (“we”, “us”). By creating an account, buying something or using Evalie, you accept them. If you accept for a company, you confirm you’re allowed to bind it, and “you” means the company.
Our privacy policy explains how we handle personal data and how to have it erased.
Evalie runs on Iridiom, a software platform we also operate, so some screens and emails at app.evalie.app may carry the Iridiom name. For Evalie, these terms apply.
What Evalie does
- Reads your manuscript or script. You choose one file per review: a novel or other prose fiction, a feature screenplay, a TV pilot or episode, a short film script, a comic book or graphic novel script, or a micro drama. Your browser extracts its text, from 300 up to 150,000 words, and sends it to Evalie once. Your AI editor works on it on our servers, so you can close the page, and we email you when your report is ready.
- Writes a report. An AI editor writes notes for the format you choose, in English or Spanish: an editor’s letter with a verdict and the notes that matter most, a ratings grid, detailed sections, and numbers measured from your text. You can download it as PDF or Markdown.
- Answers your questions. Up to 25 questions to your editor about the report and your manuscript, per review.
Evalie uses Claude, made by Anthropic. Evalie is not affiliated with, endorsed by or run by Anthropic.
Your account
- You must be 18 or over.
- Give accurate details and keep your sign-in safe. You’re responsible for what happens under your account and in your workspace, including what other people you invite to it do there.
- Tell us straight away at webmaster@evalie.app if you think someone else has got into your account.
- Your sign-in. Your email address and password are kept on Iridiom, the platform Evalie runs on, and work on the other products that run on it too. You’re only set up in another product when you sign in there, and that product’s own terms apply to what you do in it. Changing your password changes it for all of them.
Your work
- Your rights. Have reviewed only work you have the right to share with the providers that run Evalie, including our AI provider: your own work, or work you’re allowed to have reviewed. Don’t submit someone else’s unpublished work without their agreement.
- What happens to it. When you begin, your browser sends your manuscript’s text to our servers. It’s held there, encrypted, only while your report is written, then deleted, within 6 hours at most. It’s sent to our AI provider with each step of your review, and again from your browser with each question you ask, and we don’t use it to train AI. Your report keeps a synopsis of it and passages quoted from it. The privacy policy describes exactly where it goes, what we keep about it, and when the copy in your browser is erased.
- Your notes and questions. Don’t include anything you aren’t allowed to share for this purpose.
What the AI makes
- Evalie uses AI to write what it makes for you. AI can be wrong: it can misread what you gave it, state things that aren’t true, or produce something that doesn’t fit. Read everything before you rely on it or pass it on.
- What it makes is a starting point for your own judgment, not professional advice, and we don’t promise any result from using it.
- You decide what you publish or send, and you’re responsible for it, including checking that it doesn’t infringe anyone else’s rights.
- Other customers who give similar manuscripts can get similar results.
- Your editor is an AI. No person at Evalie reads your work or checks its notes.
- Its notes are opinions about the draft it read. They can be wrong, miss things, or not suit your intentions. Judge them as you would any editor’s notes.
- A verdict or rating is not a prediction. Nothing Evalie writes promises that an agent, a publisher, a studio, a network, a platform or a festival will accept your work.
- Your editor gives directions, not rewrites. If you ask, it may show a short illustrative fix; using it is up to you.
- You’re responsible for the decisions you make with the notes.
Acceptable use
You must not:
- submit work you don’t have the right to have reviewed;
- present Evalie’s notes as the opinion of a named person, a publisher, a studio or any other organisation, or as a human editor’s or reader’s report;
- use Evalie to produce anything other than notes on your work, or try to make your editor ignore its instructions;
- try to reach another customer’s data, or get around a limit, allowance or access control;
- scrape or automate Evalie other than through features we provide, or put unreasonable load on it;
- resell access to Evalie itself, or use it to build a competing product; or
- use it for anything unlawful.
Plans and payment
Everything Evalie sells is a one-time payment. There’s no subscription, nothing renews, and you’re never charged again unless you buy again.
Evalie is sold as plans, each a number of reviews. What you can buy, and its current price, is on the pricing page and at checkout:
- Single review: 1 review.
- 3-review pack: 3 reviews.
- 10-review pack: 10 reviews.
- More reviews. You can buy any plan again. Each purchase adds its reviews to the ones you have.
- The price you pay is the one shown at checkout. Prices are in US dollars and don’t include sales tax, VAT or similar taxes. Where those apply, you pay them, either to us if the law requires us to collect them, or directly to the tax authority.
- Payments are processed by Stripe. Your card details go to Stripe and never reach us.
Reviews, and when one is used
A review is one draft of one manuscript or script, its report, and up to 25 questions. Every review, on every plan, includes everything described under What Evalie does.
- Credits don’t expire. A credit you haven’t used stays available, and a finished review stays open for as long as Evalie is offered.
- Starting one. Creating a review takes one credit.
- When it’s used. A review counts as used once your editor has written its first notes on your manuscript: when the first part of its close reading comes back. Until then, if you delete the review, you get the credit back. After that, deleting it doesn’t give it back.
- One draft each. A review reads one draft, so its report always matches the text your editor read. A new draft is a new review.
- Limits. Reasonable limits keep the service fair, such as file size, a manuscript’s length, and 25 questions a review.
- Deleting a review, inside it or from your list of reviews, erases its report, questions and settings, and what Evalie kept about the manuscript; see deleting your data.
When the AI declines
The AI that writes your notes can decline a request, through its provider’s automatic safety checks or its own judgment. We don’t decide when that happens, aren’t told why, and can’t promise it won’t happen to your manuscript. What happens then:
- Before your editor has written anything. If the AI declines the first part of the close reading, the review goes back to its setup, unused, and your browser forgets the file. You can start the same review on another manuscript, or delete it and get the credit back.
- Part of the report. If it declines a later part of the reading, or a section of the report, that part is marked as declined and the rest of the report stands. You can ask your editor about that area in your questions. The review counts as used.
- The editor’s letter. If it declines to write the letter, the review starts over: everything in it is erased, as if you’d deleted it, and you can run it again with any manuscript without using another credit. You get three tries at the letter in all. If it declines the third time, the review stops, and we ask you to email webmaster@evalie.app so we can sort it out with you. A review that has started over counts as used, so deleting it doesn’t give the credit back.
- A question. A question it declines to answer doesn’t count against your 25.
Refunds
You can ask for a full refund within 14 days of a purchase if your AI editor hasn’t yet written its first notes on a review made with it. Once it has, that purchase isn’t refundable, except where the law says otherwise.
- To ask, email webmaster@evalie.app from the address on your account within 14 days of the purchase.
- After a review has been read. If we refund a purchase after a review from it has been read, for example because the law requires it, anything that review still does isn’t part of what you paid for, and we may stop it.
- What a refund does. It cancels what the purchase paid for, and it doesn’t delete anything already made. Credits not yet used from it can no longer be used.
- If you’re a consumer. If your local law gives you a right to cancel (in the EU and UK, 14 days), these terms don’t take that right away. To cancel under it, email webmaster@evalie.app within 14 days of your purchase saying you want to cancel. You don’t need to give a reason or use a form. We’ll refund you within 14 days of your message, the way you paid.
- Disputed payments. If you dispute a payment with your bank or card issuer, what that purchase paid for is suspended straight away, as with a refund. If the dispute is settled in our favor, email us and we’ll restore it.
Who owns what
- Your work is yours. Using Evalie gives us no rights in it beyond what we need to run your review: sending its text to our AI provider to write your notes and answer your questions, and keeping what our privacy policy describes.
- You let us store and process what you put in, and send it to the providers who receive data, only to run Evalie for you.
- So is the report. As between you and us, you own the reports and answers Evalie writes for you. You can use and share them for any purpose, without crediting us, as long as you don’t present them as a human’s or an organisation’s opinion.
- We own Evalie: the software, its design, the name and the logo. If you send us feedback, we may use it without owing you anything.
Availability and changes
- We work to keep Evalie running, but we don’t promise it will always be available or free of errors.
- We may change, add or remove features, and how what it makes looks.
- We may change the AI models Evalie uses.
- Download your report if you need a copy that doesn’t depend on us.
Suspension and ending
- You can stop using Evalie at any time. To have your data erased, see deleting your data.
- We may suspend or close your account if you break these terms, if a payment is reversed or disputed, or if the law requires it. We’ll tell you why, unless the law prevents us. If we close an account for breaking these terms, there’s no refund.
- If we ever stop offering Evalie, we’ll email account holders first and give you time to download your reports.
- The sections on payment, refunds, who owns what, warranties and liability, your responsibility for claims, governing law and general terms still apply after this agreement ends.
Warranties and liability
- Evalie is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those in these terms, including about the accuracy of any note or answer, its usefulness, or what happens to your work after a review, or about whether anything made with Evalie is fit for a particular purpose.
- We’re not liable for lost profits, revenue, business, data or goodwill, or for any indirect or consequential loss.
- Our total liability for all claims is limited to what you paid us in the 12 months before the claim, or $100 if you paid nothing.
- Nothing in these terms limits liability that the law doesn’t allow to be limited, such as for fraud, gross negligence or willful misconduct, or your rights as a consumer under mandatory law.
Your responsibility for claims
If someone makes a claim against us because of what you put in or published, such as work you had reviewed without the right to, or Evalie’s notes presented as a person’s or an organisation’s opinion, or because you broke these terms or the law, you’ll cover our reasonable costs and losses from it.
Governing law
These terms are governed by the law of the State of New York, USA. Disputes go to the state or federal courts in Westchester County, New York. If you’re a consumer, you keep the protection of the mandatory laws where you live and can bring a claim in your local courts.
Changes to these terms
We may update these terms. When we do, we’ll post the new version here with a new date, and the next time you use Evaliewe’ll ask you to accept it before you carry on. A change doesn’t take away what you’ve already paid for.
General
- These terms are the whole agreement between us about Evalie.
- If a court finds part of them unenforceable, the rest still applies.
- If we don’t enforce a term straight away, we can still enforce it later.
- You can’t transfer this agreement without our consent. We may transfer it to whoever takes over the business.
- We’ll send notices to the email address on your account. Send yours to webmaster@evalie.app.
